The federal judge overseeing Hunter Biden’s criminal prosecution in a Delaware federal court has struck down the sweetheart plea deal that DOJ prosecutors made with Joe Biden’s troubled son after prosecutors admitted that Hunter is currently the subject of additional investigations. Reports say that the plea deal was struck down because it shielded Hunder Biden from additional prosecutions for unrelated crimes. Now, Biden has pled not guilty to the two tax charges, and the fate of his felony gun charge appears uncertain. As a result of the plea deal’s collapse, Hunter Biden is open to additional prosecution for his years of alleged crimes.
Hunter Biden appeared in a Wilmington, Delaware federal courtroom on Wednesday to face charges of tax evasion worth millions of dollars and the felony possession of a gun while using drugs.
Prior to the court date, Biden and DOJ prosecutors had reached a plea deal in principle that would have allowed Hunter to plead guilty to two tax misdemeanors, for which he’d only be sentenced to probation, and to enter a pre-trial diversion program allowing his felony gun charge to be dismissed.
The deal has now been struck down by Judge Maryellen Noreika, who asked prosecutors if Hunter Biden is currently the subject of any other criminal investigations, a question that prosecutors answered affirmatively, but refused to provide additional details on.
She also expressed concerns over Hunter’s plea deal for his misdemeanor tax charges being linked to his felony gun charge diversion and dismissal, calling the deal “unusual”.
Reportedly, Noreika asked prosecutors if the investigation into Hunter Biden involved violations of the Foreign Agents Registration Act (FARA), but they did not provide an answer.

After striking down the plea deal, Judge Noreika put the court into a recess and Hunter Biden’s legal team went back into talks with federal prosecutors.

Hunter Biden has pled not guilty to two tax charges in federal court after he and his attorneys failed to strike a new deal with prosecutors, though initial reports suggested (perhaps hopefully) the opposite.
The original plea deal was struck down by Judge Maryellen Noreika, who expressed concern over its constitutionality and the fact that Hunter Biden is still under criminal investigation for other possible crimes.
The fate of Hunter’s felony gun charge, at this point, is unclear.
