Documents obtained by Judicial Watch using a FOIA request reveal that the DC Office of the Chief Medical Examiner submitted a request to cremate Ashli Babbitt just two days after gaining custody of her body. Still, the OCME did not release cause and manner of Babbitt’s death until April 7, 2021.
New documents obtained via a FOIA request pertaining to the death of the unarmed January 6 protestor, veteran, and patriot Ashli Babbitt, have revealed that the DC Office of the Chief Medical Examiner submitted a request to cremate Babbitt just two days after gaining custody of her body. The office did not release the cause and manner of her death until April 2021, months after the homicide took place. Babbitt’s fingerprints were emailed to a person seemingly working for the government in DC, which resulted in Microsoft “undeliverable” messages written in Chinese characters being returned, according to the report.

On January 8, 2021, at 7:13 p.m., an application to cremate the body of Babbitt is labeled “completed successfully.” Copies of the permit are sent to OCME officials Kimberli Hall and SaVern Fripp, as well as Melinda Smith, Jennifer Love, Lisa Tabron, Jeanette Belle, and Perlieshia Gales.
“There is intense public interest in the shooting of Ashli Babbitt at the Capitol on January 6,” said Judicial Watch President Tom Fitton, following the revelations. “The continued secrecy and delayed release of information about the shooting death of Ashli Babbitt are suspicious and smacks of politics. That Americans still have no information about who killed her or any police report about her death is a scandal of epic proportions.”
On April 7, 2021, Washington, D.C. medical examiner Dr. Francisco J. Diaz ruled that the death of unarmed Trump supporter Ashli Babbitt, who was gunned down by a still unidentified Capitol Hill police officer identified as Lt. Michael Leroy Byrd by independent journalist Tayler Hansen on January 6, has been classified as a “homicide” caused by a “gunshot wound to the left anterior shoulder,” as National File reported.
National File recently spoke to Michelle Witthoeft, the mother of Ashli, moments before she delivered her speech in Phoenix, Arizona after being invited by Rep. Paul Gosar to attend the TPUSA Chapter Leadership Summit. “I’m Ashli Babbitt’s mom, I’ve been invited by Congressman Gosar to speak at the election integrity rally for Donald Trump,” said Witthoeft. “My daughter died for this cause, there are still political prisoners being held in DC jail under horrible conditions as a result of this. They were protesting our American birthright to go and redress their government because everybody in this country knows that this is a stolen election. So I’m here to be my daughter’s voice because it has been silenced.”
