Former New York Mayor Rudy Giuliani has been suspended from practicing law in the state of New York, with the courts claiming he engaged in misleading claims while representing 45th President Donald Trump after the 2020 election.
The court claims “that there is uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts” while representing President Trump after the election. “These false statements were made to improperly bolster respondent’s narrative that due to widespread voter fraud, victory in the 2020 United States presidential election was stolen from his client,” the court claims. It adds that, somehow, Giuliani’s 2020 election claims now “immediately threatens the public interest and warrants interim suspension from the practice of law” pending further proceedings.
The court, in the 33 page document released today, appears to take a partisan role and declares that Giuliani and President Trump are responsible for tearing apart the country’s social fabric. “The seriousness of respondent’s unconvtroverted misconduct cannot be overstated,” the document claims. “This country is being torn apart by continued attacks on the legitimacy of the 2020 election and of our current president, Joseph R. Biden.” It also claims that Giuliani’s representation of President Trump was “intended to foment a loss of confidence in our elections and resulting loss of confidence in government” and says Giuliani’s statements “generally damage the proper functioning of a free society.”
The court document then seems to hold Giuliani responsible for the mostly peaceful Capitol Hill protests on January 6. “Where, as here, the false statements are being made by respondent, acting with the authority of being an attorney, and using his large megaphone, the harm is magnified,” the court claims. “One only has to look at the ongoing present public discord over the 2020 election, which erupted into violence, insurrection, and death on January 6, 2021 at the U.S. Capitol”. It is worth noting that, according to the D.C. Medical Examiner, the only death that occurred on January 6 as a direct result of the protests was that of Ashli Babbitt, who was slain by a still unnamed Capitol Hill police officer.
Earlier this year, federal agents raided Giuliani’s home and seized his electronic devices as part of an apparent investigation into the Ukraine hoax that claims President Trump and Giuliani threatened to withhold aid to Ukraine in exchange for an investigation of Joe Biden. Later, Giuliani’s lawyer said the former New York Mayor was treated like a “terrorist” during the raid.
